MailRook and its affiliates (collectively, "MailRook", "Company", "we" or "us") welcome you (the "User" or "you") to our website at https://mailrook.com/ and any additional website, webpages (such as landing pages of ads) and/or mobile applications owned and/or operated by MailRook (collectively, the "Site"), any free or trial version or demo, or use by paying customer's ("Customer") end users to our web-based and mobile platform, and our web-based training to assist in teaching you how best to use our products and services (collectively, the "Services"). Users may use the Site and the Services solely in accordance with the terms and conditions hereunder ("Terms of Use"), unless MailRook or its representatives execute a separate agreement with the User that explicitly states it governs the use of the Services.
Please read these Terms of Use carefully before you start using the Site and/or Services. Unless otherwise agreed by MailRook in writing, by entering, connecting to, accessing or using the Site and/or the Services you acknowledge that you have read and understood the following terms and conditions, including the terms of our "Privacy Policy" available at https://mailrook.com/legal/privacy/ collectively, the "Terms") and you agree to be bound by them and to comply with all applicable laws and regulations regarding your use of the Site and Services. Furthermore, you acknowledge and agree that these Terms constitute a binding and enforceable legal contract between you and MailRook.
We understand that your data is very precious to you. That's why our top priority is to keep our users' data secure and safe. This policy explains how we protect your personal information by ensuring your confidentiality, security and privacy.
The main principle we adhere to is restricting the collection and usage of your personal information. Our philosophy is the less people know about you, the more secure you are.
In short, we don't have any information that could identify you as an individual. And we don't have any access to your in-app data before you're creating server profile. However, when using server synchronization, you do need to associate your data with a specific e-mail address. We can't avoid this since we need to provide you with the ability to restore passwords should you forget them. We will never make your email address available to third parties not bound by this policy. But all the same, please bear in mind your preferred level of confidentiality when using server synchronization.
We collect information about you when you input it into our Site or the Service or otherwise provide it directly to us.
We collect information about you when you register for an account, create or modify your profile, and set preferences for the Service. For example, you may provide your contact information, including your first and last name, email address, and password when you register for the Service. You may also have the option of adding an avatar to your profile to be displayed in the Service. We keep track of your preferences when you select settings within the Service, including marketing and notification settings.
Instead of creating a user account, you can log in via your account with other platforms (currently Google). We will not collect the password that you use for the relevant platform, but we may collect details from your account with the platform, such as username and email address.
You may choose to provide us with information when you contact us about our Service or otherwise interact with us. For example, you may choose to submit information regarding a problem you are experiencing with our Service and send us screenshots to help in resolving the problem. You may submit your contact information to register for our events, to subscribe to receive marketing communications from us, or to make an inquiry through our Site. You may also provide content to us when you participate in a survey, contest, promotion, sweepstake, activity, or event, including via social media and other content platforms.
If you register for a paid Service, we will collect purchase information, such as the Service plan that you purchase and information related to refunds, credits, and cancellations, and your billing address and payment information. Please note that any payment information you provide is sent directly to a third-party payment processor. We have no access to and do not store your payment information.
Since an e-mail address is the only link between the abstract set of data and your personality, we highly recommend you use an e-mail address that is NOT associated with your social networks accounts or your name and surname. If you decide to use your primary e-mail address, please maintain confidentiality of this e-mail address, your password and the fact that it is associated with your account. We recommend you to delete the welcome e-mail we sent to you after reading, and under no circumstances should you provide your credentials to any third-party, as well as to our customer support. If you suspect your credentials have been obtained illegally, please immediately change your password inside the application. We can't be held responsible if someone else accesses your server profile through registration credentials obtained from you.
We are committed to not sharing, exchanging, selling or renting any of your personal information to any third-party. We only use this data internally for the following purposes:
We use all reasonable electronic and physical safety procedures to protect your information. We store your password in encrypted form so your password can't be recovered in any other way apart from the standard procedure of restoring it via your e-mail address. Our servers are located in the EU in a secured facility.
Certain Services are offered under different pricing plans, the limits and features of which are available at mailrook.com/pricing. Your rights and obligations with respect to certain Services will be based in part on the pricing plan you choose.
6.2.1. When you purchase Services (each such purchase, a "Subscription"), you expressly authorize us or our third-party payment processor to charge you for such Services. You represent and warrant that you have the legal right to use all payment methods that you provide to us.
6.2.2. All fees are stated and solely payable in U.S. Dollars (unless otherwise stated during the payment process), non-cancelable, non-refundable (except as otherwise expressly set forth in these Terms), and not subject to setoff.
6.2.3. In the event that you fail to pay the full amount owed to us, we may limit your access to the Services, in addition to any other rights or remedies we may have.
6.3.1. All pricing plans involve recurring fees (each, along with any applicable taxes and other charges are a "Subscription Fee"). Depending on which options you choose, those fees may recur each month, quarter or year thereafter, at the then-current rate. Please note that our fees are subject to change, although we will notify you before we effect any change.
6.3.2. By agreeing to these Terms and purchasing a Subscription, you acknowledge that your Subscription has recurring payment features and you accept responsibility for all recurring payment obligations prior to cancellation of your Subscription by you or MailRook. We (or our third party payment processor) will automatically charge you in accordance with the term of your Subscription (e.g., each month, quarter, or year), on the calendar day corresponding to the commencement of your Subscription using the payment information you have provided.
6.3.3. In the event your Subscription begins on a day not contained in a later month, your payment method will be charged on such other day as we deem appropriate. For example, if you started a monthly Subscription on January 31st, your next payment date is likely to be February 28th, and your payment method would be billed on that date. We may also periodically authorize your payment method in anticipation of applicable fees or related charges.
6.3.4. Your Subscription continues until canceled by you or we terminate your access to or use of the Services or the Subscription in accordance with these Terms.
6.4.1. You may cancel your Subscription at any time but please note that such cancellation will only be effective at the end of the then-current Subscription period. Unless required by law, YOU WILL NOT RECEIVE A REFUND OF ANY PORTION OF THE SUBSCRIPTION FEE PAID FOR THE THEN-CURRENT SUBSCRIPTION PERIOD AT THE TIME OF CANCELLATION.
6.4.2. To cancel, you can either (i) email us at [email protected] and follow any instructions, if any, we provide to you in response to your cancellation request, or (ii) for some kinds of Subscriptions, initiate a cancellation through your MailRook account settings within the Services. You will be responsible for all Subscription Fees incurred for the then-current Subscription period. Canceling your Subscription will not terminate your MailRook account. See Section 10 (Termination) below for information on terminating your MailRook account.
6.5. Taxes. Subscription Fees do not include taxes, and you agree to: (a) pay all sales/use, gross receipts, value-added, GST, personal property, or other tax (including any interest and penalties) with respect to the transactions and payments under these Terms, other than taxes based on our income, employees, or real property; and (b) be responsible for any filing of any information or tax returns with respect thereto.
6.6. Withholding. All payments made by you to us under these Terms will exclude any deduction or withholding. If any such deduction or withholding (including but not limited to cross-border withholding taxes) is required by law, you will pay such additional amounts as are necessary so that the net amount received by us after such deduction or withholding will be equal to the full amount that we would have received if no deduction or withholding had been required. Each party will use commercially reasonable efforts to work with the other party to help obtain, reduce, or eliminate any necessary withholding, deduction, or royalty tax exemptions where applicable.
We may update this privacy policy if circumstances change. The date of policy revision always remains on top of the page. Changes take effect immediately after posting.
